This policy sets forth the warranty and after-sales service terms applicable to products sold on the website www.viallecontainer.com

2. Statutory Warranty of Conformity

In accordance with Articles L217-3 through L217-20 of the French Consumer Code, the consumer is entitled to a statutory warranty of conformity valid for a period of 2 years from the date of delivery of the goods.

 

The seller is required to deliver goods that conform to the contract.

2.1 Lack of Conformity

 

Goods are considered non-conforming, in particular, when they:​

 

• do not match the description provided

• do not possess the advertised qualities

• are not fit for the purpose for which they are typically intended

• do not possess the qualities that a consumer can legitimately expect

2.2 Exercising the Warranty

 

In the event of a lack of conformity, the consumer may request:​

 

• repair of the product

or

• its replacement

In accordance with Article L217-12 of the Consumer Code, the seller may refuse the chosen remedy if it entails a manifestly disproportionate cost.

If repair or replacement is impossible or cannot be carried out within a reasonable time, the consumer may request:​

• a price reduction

or

• termination of the contract (refund)​

 

Bringing the product into conformity is carried out at no cost to the consumer.

2.3 Presumption That the Defect Existed at the Time of Delivery

Pursuant to Article L217-7 of the Consumer Code, defects that appear within 24 months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.​

 

3. Statutory Warranty Against Hidden Defects

In accordance with Articles 1641 through 1649 of the Civil Code, the seller is bound by the warranty against hidden defects.​

 

The consumer may choose between:

• cancellation of the sale (full refund)

• a price reduction

The claim must be filed within 2 years of the discovery of the defect.​

 

4. Commercial Warranty​

 

No additional commercial warranty is provided, unless expressly stated on the product page.

Any commercial warranty:

• is separate from statutory warranties

• does not limit or replace statutory warranties​

An acknowledgment of receipt is generally sent within 48 business hours.

5.2 Processing Procedure

• arrangement of return shipping if necessary

• product diagnosis

• implementation of the appropriate solution (repair, replacement, or refund)

5.3 Processing Times

Requests are processed within a reasonable timeframe, in accordance with applicable regulations.

Processing times may vary depending on the nature of the product and logistical constraints.​

 

6. Warranty Exclusions

The warranty does not cover:

• normal wear and tear

• damage resulting from misuse

• unauthorized modifications

• damage caused by a third party​

 

These exclusions do not in any way limit mandatory statutory warranties.

7. Costs

In the event of a claim under a statutory warranty:

• no costs are charged to the consumer

• shipping costs related to a lack of conformity are covered by the seller

8. Mandatory Legal Notice

The consumer is entitled to:

 

• the statutory warranty of conformity provided for in Articles L217-3 et seq. of the Consumer Code

• the warranty against latent defects provided for in Articles 1641 et seq. of the Civil Code

9. Regulatory Compliance

This policy complies with:

No clause limits the consumer’s legal rights.
